Welcome to CalmPulse. CalmPulse is an application designed to provide support for managing anxiety and stress through interactive tools, feedback mechanisms, and AI-driven recommendations. By accessing or using CalmPulse, you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Eligibility

You must be at least 18 years old to use CalmPulse. By using this App, you affirm that you meet this requirement.

3. No Medical Advice or Professional Consultation

• CalmPulse does NOT provide medical, psychological, or professional advice.
• The App is NOT a substitute for medical treatment, therapy, or professional counseling.
• If you experience a mental health crisis, seek professional help immediately.
• In no event shall CalmPulse, its developers, partners, or affiliates be held liable for any reliance placed on the App's content.
• The information provided through the App, including AI-driven recommendations, is for informational purposes only.

4. Use of AI-Powered Support (PULSE AI)

• PULSE AI offers emotional support but does NOT replace professional mental health services.
• Recommendations provided by PULSE AI are based on general well-being practices and NOT medical evaluations.
• PULSE AI will NEVER provide medical, diagnostic, or prescription-related advice.
• The AI adapts to user interactions but does not function as a medical or licensed professional.
• The developers of CalmPulse disclaim any liability related to reliance on AI-generated suggestions.

5. User Responsibilities

• You agree to use the App solely for personal, non-commercial purposes.
• You must not misuse, copy, distribute, or reverse-engineer the App.
• You are solely responsible for your interactions with the App and any consequences arising from it.
• You agree not to use the App to collect or share medical data or personal health records of third parties.
• Users are solely responsible for any media they upload to the App, including MP3 files, images, and videos.
• Uploaded media files are stored locally on the user's device and are not publicly shared within the App.

6. Privacy & Data Collection

• We collect personal data such as name, age, gender, email, user habits, and AI-generated insights.
• Your data is collected to improve user experience and optimize PULSE AI support.
• Data is securely stored and protected.
• You may delete all your data at any time via account deletion in Settings / User, or via our Account Deletion page.
• We do not sell, share, or distribute personal information to third parties beyond what is necessary for functionality.

7. Security & Data Breach Response

In the event of a data breach that compromises user information, we will take appropriate measures to investigate and mitigate the issue. Where legally required, we will notify affected users through in-app notifications and/or email.

8. Subscriptions & Payments

• Premium subscriptions are managed through Apple App Store & Google Play.
• Refunds, cancellations, and billing are governed by the respective app store policies.
• We do not process or store payment details; all transactions are handled by third-party platforms.
• By purchasing a subscription, users agree to comply with the terms and policies of the relevant app store.

9. Advertising & Third-Party Services

• The App uses Google Ads, which may personalize advertisements based on user activity.
• By using the App, you acknowledge and agree to this advertising model.
• Third-party advertisers may use cookies and tracking mechanisms; users can manage their preferences via their device settings or Google's Ad Settings.

10. Termination & Account Deletion

• Users may delete their accounts and associated data through the App settings or our web deletion page.
• If the App ceases operation, user data will be retained for 30 days before being permanently deleted.
• We reserve the right to suspend or terminate accounts if a user violates these Terms or engages in misuse.
• Upon account deletion, all personal data will be retained for 30 days to allow for recovery if the user chooses to reactivate their account. After this period, all personal data will be permanently erased.

11. Prohibited Use

• Users agree not to use the App for any unlawful, harmful, or abusive purpose, including but not limited to harassment, threats, or unauthorized data collection.
• Any violation of this policy may result in immediate account termination.

12. Limitation of Liability

• CalmPulse is provided "as is" without warranties of any kind.
• We are NOT responsible for any direct, indirect, incidental, or consequential damages resulting from your use of the App.
• CalmPulse and its developers are not responsible for any interruptions, errors, or downtime.
• Users agree that they will not hold CalmPulse liable for any damages arising from the use of the App, including but not limited to loss of data, emotional distress, or service unavailability.

13. Intellectual Property & Copyright

• All content, trademarks, and technology used in the App, including AI algorithms and design elements, are the exclusive property of CalmPulse and its licensors.
• Users may not copy, modify, or distribute any aspect of the App without explicit permission.

14. Modifications to Terms

• We may update these Terms at any time. Continued use of the App constitutes acceptance of any modifications.
• Users will be notified of significant changes where legally required.

15. Governing Law & Dispute Resolution

• Disputes will be resolved through arbitration or the applicable legal jurisdiction.
• Users waive any right to participate in class-action lawsuits against CalmPulse.
